It’s official: Britney Spears has formally filed to have her father, Jamie Spears, removed as conservator for her estate. Britney’s new attorney filed a motion late Monday to remove her father, and included new testimony from her medical team that advised his removal. After 13 years of being silenced, it seems like Britney Spears is finally, truly being heard.

Mathew Rosengart, who was hired to represent Britney earlier this month, requested that the court remove Jamie and replace him with Jason Rubin, a California-based certified public accountant. Rosengart said Rubin’s experience is primarily in handling financial elder abuse and handling trust portfolios.

The filing states that Britney wants Rubin to manage her estate and real estate, and wishes to give him power of attorney to make health decisions.


Currently, Britney’s dad manages all of her finances while Jodi Montgomery is in control of all of Britney’s personal affairs and health decisions—as stated by Britney in her eye-opening testimony last month, she’s allegedly unable to remove her IUD to have more children because of this.

The conservatorship initially went into effect in 2008, after Britney was tormented by paparazzi while she was a new mom (and going through a very public divorce to boot).

Britney’s medical team supports the decision to remove her father as conservator, according to the filing, in favor of her “emotional well-being.”

Montgomery reportedly also agrees with the removal of Jamie Spears, as stated in the court documents. She says she has personally witnessed the relationship between Britney and Jamie, and described their dynamic as “not psychologically healthy” for the singer’s mental health. She called Jamie Spears’ removal critical to Britney Spears’ mental health and added that it is her belief that no relative should be in charge of the case—including her mother, Lynn Spears, who is also on record in the documents as supporting the decision to remove Jamie from power.

“I have had numerous, ongoing conversations with the medical team, and we all agree that it would be best for Ms. Spears’ well-being and mental health that her father stop acting as her Conservator,” Montgomery said.

In the petition to remove Jamie Spears, Rosengart implied that he isn’t ruling out further legal action against Jamie in the future, saying he’s “guilty of misfeasance or malfeasance” in his daughter’s case. Per NBC News, Jamie Spears has profited from his daughter’s estate, taking a salary of $16,000 a month in addition to costs for office space and taking fees from her performance contracts.

The next hearing in the case is scheduled for September 29.
